Terms of Service

These Terms of Service ("Terms") govern your use of Cerebro ("the App"), operated by Allonsy GmbH ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Cerebro, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the App. We recommend that you also review our Privacy Policy, which explains how we handle your data.

2. Service Description

Cerebro is an iOS keyboard extension that provides voice-to-text transcription. The App records audio on your device, sends it to our server for processing via our speech recognition service, and returns the transcribed text to your device. Cerebro also offers optional features such as polite mode text transformation and AI-assisted text improvement.

3. Acceptable Use

You agree to use Cerebro only for lawful purposes. You may not:

• Use the App to transcribe content that violates applicable laws or regulations.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App's servers or infrastructure.
• Use the App to process content that infringes on the rights of third parties.
• Circumvent or attempt to circumvent usage limits or access controls.

4. Voice Data Processing

When you use the voice-to-text feature, audio is recorded on your device and transmitted to our server, which processes it through our speech recognition service for transcription. Audio is not stored on our servers and is discarded immediately after processing. Transcription results are returned to your device and stored locally only.

You are responsible for ensuring that any audio you submit does not contain sensitive personal data of third parties without their consent.

5. Third-Party Services

Cerebro relies on a third-party speech recognition service for transcription. By using Cerebro, you acknowledge that your audio data will be processed by a third-party service provider for transcription purposes. We are not responsible for how third-party providers handle data processed through their services.

6. Intellectual Property

All rights, title, and interest in the App, including but not limited to its design, code, graphics, and trademarks, are owned by Allonsy GmbH. You are granted a limited, non-exclusive, non-transferable license to use the App for personal or business purposes in accordance with these Terms.

You retain ownership of all content you create or transcribe using the App.

7. Pricing and Subscriptions

Cerebro offers a free tier with a limited number of daily transcriptions. Additional transcriptions are available through a paid subscription, managed via Apple's In-App Purchase system.

• Subscription prices are displayed in the App and may vary by region.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your Apple ID settings.
• Refunds are handled by Apple in accordance with their refund policies.

8. Disclaimers

Cerebro is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's accuracy, reliability, or availability. Transcription results may contain errors, and you are responsible for reviewing and verifying any transcribed text before use.

We do not guarantee uninterrupted access to the service. Maintenance, updates, or external factors may temporarily affect availability.

9. Limitation of Liability

To the extent permitted by applicable law, Allonsy GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

Nothing in these Terms excludes or limits our liability for damages arising from intent or gross negligence, or for any other liability that cannot be excluded or limited under German law. For cases of slight negligence, our liability is limited to breaches of essential contractual obligations (cardinal obligations), and in such cases, liability is limited to the foreseeable, typically occurring damage.

10. Termination

You may stop using Cerebro at any time by uninstalling the App. We reserve the right to suspend or terminate your access to the service if you violate these Terms or engage in conduct that we reasonably believe is harmful to the service or other users.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hamburg, Germany.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
